Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Clonx platform ("Service") operated by Clonx ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To access the Service, you must create an account using a valid email address or third-party authentication (such as Google). You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account

You must notify us immediately of any unauthorised use of your account.

3. Use of the Service

The Service provides LinkedIn analytics, AI-powered content generation, and voice profile management. You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to generate content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorised access to the Service, other accounts, or related systems
• Use the Service to spam, harass, or send unsolicited communications
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means (bots, scrapers) to access the Service without our prior written consent
• Violate LinkedIn's Terms of Service or any applicable third-party terms

4. Your Content

You retain ownership of all content you provide to the Service, including LinkedIn post data, voice profiles, and any text you input ("Your Content"). By using the Service, you grant us a limited, non-exclusive licence to use Your Content solely for the purpose of providing and improving the Service.

You represent and warrant that you have the right to provide Your Content and that it does not infringe the rights of any third party.

5. AI-Generated Content

The Service uses artificial intelligence to generate content based on your inputs and voice profiles. You acknowledge that:

• AI-generated content is provided as suggestions and should be reviewed before use
• We do not guarantee the accuracy, quality, or suitability of AI-generated content
• You are solely responsible for reviewing and publishing any content generated through the Service
• AI-generated content may not be unique and similar content may be generated for other users

You own the AI-generated content produced through your use of the Service and may use it for any lawful purpose.

6. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Clonx and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

7. Third-Party Services

The Service integrates with third-party services including LinkedIn, Google, Supabase, and Anthropic. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party services.

8. Fees and Payment

The Service is currently provided free of charge. We reserve the right to introduce paid features or subscription plans in the future. If we do, we will provide reasonable notice and the opportunity to cancel before any charges apply.

9. Availability and Modifications

We strive to maintain the Service's availability but do not guarantee uninterrupted or error-free operation. We reserve the right to:

• Modify, suspend, or discontinue the Service (or any part of it) at any time
• Perform maintenance that may temporarily affect availability
• Update these Terms with reasonable notice

10. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service if:

• You breach these Terms
• Your use of the Service poses a security risk
• We are required to do so by law
• We discontinue the Service

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your requirements, be error-free, or that any defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by Australian law, in no event shall Clonx be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

13. Indemnification

You agree to indemnify and hold harmless Clonx and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any third-party rights.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Australia and the State of New South Wales. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Clonx regarding the Service and supersede all prior agreements and understandings.
